1. The Customer
For the purpose of this contract the ‘customer’ shall be defined as the
person whose name appears on the payment details of the order.
www.timbrownart.co.uk is owned and run by One.Art. One.Art may be referred to as
'We' 'Us' 'Our'.
2. Delivery
a) Goods will be delivered within 7-10 Working Days (Mainland UK) by Carrier
to the address given at the time of order.
c) Once each order leaves our premises, it becomes the customer's
responsibility, and Printed Pictures will accept no liability for the safety of
the order.
d) Any changes to the delivery address must be communicated to One.Art by email
within 24 hours of placing your order. Please state the Customer Order Number on
All communications with us. One.Art will not take any responsibility for any
delays caused by changes to the delivery address if these are not communicated
accurately and promptly. One.Art will not change any delivery details if the
Customer Order Number is not quoted.
e) The standard delivery charge to Mainland UK is £7.50 - this includes postage
insurance.
3. Payment
All goods are to be paid at the time of order. When paying for your order,
you will be automatically be re-directed to Protx All of our payments are
processed though Protx. Protx is a registered secure site. Payment will appear
on your bank statement as One.Art.
4. Refunds and Exchanges
If you are at all unhappy with your purchase you may send it back for an
exchange or refund. Please send all returns to : One.Art, Downholme Park, Reeth
Road, Richmond, North Yorkshire, DL11 6AA
We will be happy to make you a refund or exchange and only ask that you please
return your print in it’s original condition you received it from us within 14
days of receipt. Goods are returned at your own expense.
Please also ask for proof of posting certificate when returning prints as we
cannot be held responsible for goods lost in transit to us. We regret that we
cannot refund this charge.
You will receive your refund credit within 14 days of receipt. All refunds are
given to the original purchaser.
6. Specifications
a) All goods will be made in accordance with the specifications detailed on
the website. It is the customer's responsibility to ensure they have read and
understood such specifications.
7. Shading and Colour Variation
a) Due to limitations in the printing process, slight colour variations may
occur between prints.
Whilst One.Art will make every reasonable endeavour to minimise this, it is not
always possible to eliminate this eventuality completely. In these circumstances
One.Art cannot accept any liability for shading variations.
To minimise colour variations between prints, if you are ordering multiples, it
is advisable to order all prints at the same time, in the same order. Nothing in
this clause shall affect your statutory rights.
8. Limitation of Liability
a) One.Art shall not be liable for any indirect or consequential loss,
however arising as a result of any act, omission, or default of One.Art its
employees, servants or agents.
b) Nothing in this contract shall act as a limitation or exclusion of liability
for death or personal injury arising as a result of negligence from One.Art, its
employees, servants or agents.
9. Force Majeure
One.Art shall not be liable for any default in its obligations hereunder as a
result of any act of God, war, strike, act of terrorism, lockout, industrial
action, fire, flood, drought, tempest, or storage of materials, or any other
event beyond its reasonable control.
10. General
a) Headings - all heading are for ease of reference only, and shall not
affect the construction of this contract.
b) Severance - any provision of this contract, which is, or may be, held by any
competent judicial authority to be void or voidable, shall be deemed severable
and shall not affect any other provision of this contract.
c) Applicable Law - this contract is subject to the law of England and all
disputes arising here shall be subject to the jurisdiction of the English
Courts.
d) Variation - none of the terms and conditions of this contract shall be varied
except in writing and signed by the proprietor of One.Art.

practices described in this Privacy Policy, to the extent allowed by applicable
law. It is possible that One.Art, its subsidiaries, its joint ventures, or any
combination of such, could merge with or be acquired by another business entity.
Should such a combination occur, you should expect and agree that that One.Art
may share some or all of your information in order to continue to provide the
service. You will receive notice of such event (to the extent it occurs) as
provided in Section 9 ("Notice") and we will require that the new combined
entity follow the practices disclosed in this Privacy Policy.
(b) Legal Requests. One.Art co-operates with law enforcement inquiries, as well
as other third parties, to enforce laws and third party rights, such as
intellectual property rights and laws relating to fraud. Therefore, in response
to a verified request by law enforcement or other government officials, such as
Section 29 (3) Data Protection Act 1998 form relating to a criminal
investigation or alleged illegal activity, or other activity that may expose us
or you to legal liability, we can (and you authorise us to) disclose personal
information such as name, address, telephone number, email address, in our sole
discretion, believe necessary or appropriate.
We cannot ensure that all of your communications with One.Art and other
personally identifiable information will never be disclosed in ways not
otherwise described in this Privacy Policy. For example, third parties may
unlawfully intercept or access transmissions or private communications, or users
may abuse or misuse your information that they collect from the Site. Therefore,
although we use industry standard practices to protect your privacy, we do not
promise, and you should not expect, that your personally identifiable
information or communications with One.Art will always remain private.

Except as otherwise expressly included in this Privacy Policy, this document
only addresses the use and disclosure of information we collect from you. To the
extent that if you disclose your information to other parties, or other sites
throughout the Internet, different rules may apply to their use or disclosure of
the information you disclose to them. Since One.Art does not control the privacy
policies of third parties, you are subject to the privacy policies of that third
party. We encourage you to ask questions before you disclose your personal
information to others.
5. Security.
One.Art uses industry standard practices to safeguard the confidentiality of
your personal identifiable information, firewalls and Secure Socket Layers.
One.Art treats data as an asset that must be protected against loss and
unauthorised access. However, "perfect security" does not exist on the Internet.
6. Payments.
We use Protx Internet Bank to process all of our payments. You will be
automatically redirected to their site when you click to complete your purchase
with us. Protx have their own Privacy Policy, and we urge you to read that also
before completing your transaction, as they may not hold the same policies as
us.
7. Notice.
We may amend this Privacy Policy from time to time in order that it accurately
reflects the regulatory environment and our own data collection and disclosure
practices. All amended terms shall automatically be effective 10 days after they
are initially posted on the Site. In addition, we will notify you in accordance
with your notification preferences or by posting the amended Privacy Policy on
the Site.
